On July 6th, 2025, the State Administration for Market Regulation (hereinafter referred to as "SAMR") published six typical cases of violations in the field of product quality, including Case No. 3, which involves a company selling fertilizer using the factory name of a Spanish company without authorization.
In this case, on July 15, 2024, during an inspection, the Hainan Provincial Market Supervision Administration discovered 23.6 tons of "Haofudi" water-soluble fertilizer stored in the warehouse of Hainan Kangxifeng Crop Technology Co., Ltd. (hereafter, "Kangxifeng Company"), which was suspected of labeling or using another company's factory name. Upon investigation, it was found that Kangxifeng Company had purchased 60 tons (with an additional 5.48 tons as a gift) of "Haofudi" water-soluble fertilizer from Shenzhen Longer Ecological Technology Co., Ltd. (hereafter, "Longer Company"). The packaging indicated that the fertilizer was manufactured by the Spanish Arvensis company and imported by China National Agricultural Means of Production Group Co., Ltd. After examination, it was confirmed that this batch of fertilizer had not been imported by the authorized importing entity, and Longer Company was unable to provide valid import documentation or evidence to prove the fertilizer's origin from Arvensis.
Finally, the actions of Kangxifeng Company were found to be in violation of Article 53 of the Product Quality Law of the People's Republic of China, which prohibits the sale of products using another company's factory name without authorization. Based on Articles 53 and 55 of the foregoing law, on May 26, 2025, the Hainan Provincial Market Supervision Administration ordered the parties concerned to correct their illegal behavior, confiscated 23.6 tons of unauthorized fertilizer, seized illegal gains of RMB 9,500, and imposed a fine of RMB 230,400.
